These Terms and Conditions are governed by Malaysian law. By participating in our affiliate program, you acknowledge that you cannot take legal action against Velquest or its operators for any losses, and you agree to resolve all disputes through binding arbitration in Malaysia.
By registering for the Velquest affiliate program, you agree to be bound by these Terms and Conditions. These terms constitute a legal agreement between you and Velquest.
If you do not agree to these terms, you must not participate in our affiliate program.
Governing Law: These terms are governed by the laws of Malaysia, and any disputes shall be subject to the exclusive jurisdiction of Malaysian courts.
2.1 Ethical Promotion: You must promote our products honestly and ethically. False claims, misleading advertising, or spam promotion is strictly prohibited.
2.2 Compliance: You agree to comply with all applicable laws, including Malaysian advertising and consumer protection laws.
2.3 Brand Protection: You may not use our trademarks or brand names in domain names, social media handles, or business names without written permission.
2.4 Content Standards: All promotional content must meet professional standards and reflect positively on the Velquest brand.
3.1 Commission Rates: Commission rates are as published on our website and may be changed with 30 days notice.
3.2 Payment Terms: Minimum withdrawal is RM100. Payments processed within 3-7 working days upon request.
3.3 Verification: Malaysian affiliates must provide RM10 verification deposit and valid identification. International affiliates require PayPal verification.
3.4 Payment Methods: TNG eWallet, DuitNow (Malaysia), PayPal (International). We reserve the right to modify payment methods.
3.5 No Guarantee: Commission earnings are not guaranteed and depend entirely on your marketing efforts and results.
4.1 NO LIABILITY: VELQUEST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE AFFILIATE PROGRAM.
4.2 NO LEGAL ACTION: YOU EXPRESSLY WAIVE ANY RIGHT TO BRING LEGAL PROCEEDINGS AGAINST VELQUEST OR ITS OPERATORS FOR ANY LOSSES, DAMAGES, OR DISPUTES RELATED TO THIS PROGRAM.
4.3 MAXIMUM LIABILITY: Our total liability to you for any reason shall not exceed the total commissions paid to you in the 12 months preceding the claim.
4.4 INDEMNIFICATION: You agree to indemnify and hold harmless Velquest from any claims, damages, or expenses arising from your breach of these terms.
4.5 ASSUMPTION OF RISK: You acknowledge that affiliate marketing involves business risks and you assume all such risks voluntarily.
5.1 Termination by Us: We may terminate your affiliate account immediately for breach of terms, fraudulent activity, or at our sole discretion.
5.2 Termination by You: You may terminate your participation by emailing [email protected].
5.3 Effect of Termination: Upon termination, your right to earn commissions ends, but you remain entitled to unpaid commissions earned before termination.
5.4 Survival: Limitation of liability, indemnification, and governing law clauses survive termination.
6.1 Binding Arbitration: All disputes must be resolved through binding arbitration in Malaysia under Malaysian Arbitration Act 2005.
6.2 No Class Actions: You waive any right to participate in class action lawsuits or class-wide arbitration.
6.3 Governing Law: These terms are governed by Malaysian federal law and the laws of Malaysia.
6.4 Language: All proceedings shall be conducted in English or Bahasa Malaysia at our discretion.
7.1 PDPA Compliance: We comply with Malaysia's Personal Data Protection Act 2010 (PDPA).
7.2 Data Collection: We collect personal data necessary for program administration and payments.
7.3 Data Use: Your data is used for program management, payments, and communication. We do not sell your data to third parties.
7.4 Data Security: We implement reasonable security measures to protect your personal information.
8.1 Entire Agreement: These terms constitute the entire agreement between parties.
8.2 Modifications: We may modify terms with 30 days notice via email or website posting.
8.3 Severability: If any provision is unenforceable, the remainder remains in effect.
8.4 Assignment: You may not assign your rights without our written consent. We may assign freely.
